Welcome to SmallBizGen. These Terms of Service (“Terms”) govern your access to and use of the SmallBizGen platform, website, and services (collectively, the “Service”) operated by 3WB Holdings, LLC (“Company,” “we,” “us,” or “our”).

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using SmallBizGen, you represent that you meet these requirements.

2. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately of any unauthorized use of your account.

3. Service Description

SmallBizGen is an AI-powered website builder that allows users to create, manage, and publish websites. The Service may include:

  • AI-generated website content and design
  • Website hosting and publishing
  • Blog content management
  • SEO tools and analytics
  • Custom domain connectivity
  • Template marketplace
  • Form submissions and lead capture

4. Subscription Plans & Billing

4.1 Plans

We offer Free, Pro, and Agency subscription plans. Plan features, limits, and pricing are described on our pricing page and may change with 30 days’ notice.

4.2 Payment

  • Paid plans are billed monthly or annually via Stripe.
  • All fees are non-refundable except as required by law or as described in our refund policy.
  • We may change pricing with 30 days’ written notice to your registered email.

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. Your sites will be unpublished after cancellation unless you are on the Free plan.

5. AI-Generated Content

5.1 Ownership

Content generated by our AI tools for your websites belongs to you. You grant us a limited license to host, display, and transmit that content as necessary to provide the Service.

5.2 Accuracy

AI-generated content is provided “as-is.” While we strive for quality, we do not guarantee the accuracy, completeness, or suitability of AI-generated text, images, or design. You are responsible for reviewing and editing all content before publishing.

5.3 Prohibited Content

You may not use the Service to generate or publish content that:

  • Is unlawful, defamatory, obscene, or harmful
  • Infringes on intellectual property rights of others
  • Contains malware, phishing, or deceptive material
  • Promotes illegal activities or violence
  • Violates any applicable law or regulation

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Use automated tools to scrape or extract data from the Service
  • Resell or redistribute the Service without authorization
  • Upload viruses or malicious code
  • Impersonate any person or entity

7. Intellectual Property

7.1 Our IP

The Service, including its design, code, features, and branding, is owned by 3WB Holdings, LLC and protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks, logos, or proprietary technology.

7.2 Your Content

You retain ownership of content you create or upload. By using the Service, you grant us a worldwide, non-exclusive license to host, store, and display your content solely to provide the Service.

7.3 Marketplace Templates

Templates purchased through the marketplace are licensed for your use per the template creator’s license terms. You may not resell or redistribute purchased templates.

8. Custom Domains

If you connect a custom domain, you represent that you own or have rights to that domain. We are not responsible for domain registration, DNS configuration, or domain-related disputes.

9. Data & Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Service, you consent to our data practices as described therein.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted or error-free
  • AI-generated content will be accurate or suitable for any purpose
  • Your published websites will achieve any particular search ranking or traffic
  • The Service will meet all of your requirements

11. Limitation of Liability

To the maximum extent permitted by law, 3WB Holdings, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless 3WB Holdings, LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

  • We may suspend or terminate your account for violation of these Terms.
  • You may delete your account at any time through account settings.
  • Upon termination, your published websites will be taken offline.
  • We may retain certain data as required by law or for legitimate business purposes.

14. Changes to Terms

We may update these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Mecklenburg County, North Carolina.
